Hey guys, Im new to the site and have read the guidelines and all sorts of posts about visits/fiances/k1 there are.

My question is very specific,

I have a pending and almost approved K1 in the National Visa Center, we're waiting for the letter any minute now.

Since my fiance lives here in the US, I came to visit for the holidays. I have entered the US 6 times since 2014 to visit him and haven't stayed longer than 15 days at a time even though border control always gave me 6months B2 visas.

However, this past december 15th, I flew in Dulles Intl. and a very nice immigration officer told me that since Ive entered the US too many times, I will or am at risk of getting sent back home if I come before the 6months' permission he's stamped in my passport. He didn't know I have a pending K1.

Does this mean that when I come to get married here, with an approved K1 and my sealed envelope and wedding dress and all, Im at risk of getting sent back?

he said that most tourists don't understand that even when you get a Multiple Entrance Visa from the embassy, this doesn't mean they can visit as often as they want. I did not understand that, since I always leave when Im supposed to and never stay longer than 2 weeks.

I just don't want to be rejected when I come here to get married and our wedding is planned to take place at the end of May the latest!!

Please help!

thank you

Alex

I think he may have been just a little grumpy...if you have a multiple entry visa, you should be able to visit when you want as long as you don't overstay. You'd also want to make sure that you don't spend the 6 months available, go back home for a little while, and come right back for another 6 months. That can look pretty fishy.

As for the K1 entrance, that will be on a completely different visa- it is technically a non-immigrant visa with immigrant intent, so they know your intent is to stay. The tourist visa is to be used for tourism/visiting only. There shouldn't be any problems because the point of a K1 is to stay.

Also, if you look at the post from Tom (the post with the pdf attachment), it gives you great instructions at the NVC stage without "waiting" for a letter. Good luck!!

It is suggested that you not book anything that is not refundable. Anything can happen in this process that delays it. There is no guarantee when someone will get their visa and arrive until they have their visa in hand. Be mindful while you're booking things and making plans.

This is the difficult part of having a K1! I'm in the process of planning our wedding and all the details without a date and without actually booking anything.

If you have all of the requirements to obtain the k-1 when you go for interview in your country, it most often takes only weeks not months to get the k-1.

If you fulfill all of the packet 3 information requested and have everything in order , it will not be likely to get into administrative processing.

Look over the country specific k-1 journeys and see how things usually play out in your country.

Keep in mind, once the k-1 is issued, it has an expiration date of 6 months from date of approval.

If your approval is very quick, you may not want to hold off that long for a wedding as it has to be within 90 days of your touchdown on U.S. Soil

The K1 visa actually has a validity of 6 months after the date of the medical exam, not 6 months from the date of the approval.

an example: If you had your medical exam January 5th and you were approved at your interview March 5th- the expiration on your visa would be July 5th.

Also, while a lot of people are not put on administrative processing, some people do and it can take days to months to be cleared.

OP, if it's your friend's property, I would say go ahead and book as long as any deposit can be refundable. I just don't want you to lose out on any money!

YUP, goofed on the expiration !!! Thanks for making sure to verify that for the OP. That is also why I asked Country. If they look at the country specific posts, they will get a better idea of the timelines and instances of administrative processing. Some countries really have a higher incidence of that than others. Some countries seem to fly their applicants through quickly. Good luck with your process. Hope you all get through quickly !!
