Hey all,

I am now onto the interview phase. I will be having an interview probably sometime in January here at the NVC in Peru. We are doing the IR-1 for my wife, as we've been living here in Peru after our marriage for roughly 22 months now.

It's asking me for the following with regards to the affidavit of support I-864: W2 and the taxes, and form 1040 from last year.

This is where I'm a little confused. I'm not entirely sure what they mean by "W2", first of all. So if someone could specify, that'd be great. And the 1040 form is the tax form that the IRS mails you, right? If so, what if you haven't filed for taxes since the year 2013 due to living abroad and not making anything close to the 9 or so grand yearly limit.

Also, My step-father will be helping us out by joint sponsoring with me since I don't make above the poverty line limit. If I understand correctly, he'll have to sign out the affidavit form and send in his w2 and 1040 from last year to me here in Peru to take to the interview, right? Or could he scan it to me?

I hope this makes sense.

Really the best form of tax/financial evidence you can provide them is a tax transcript. I also had these problems going through NVC with my Dad as a joint sponsor. If you just have him send you tax transcripts from the last 3 years. Did you already submit everything to NVC? If so, they should have already handled your situation with not having filed taxes.

On a side note, when did you get a case closed from NVC? My husband will hopefully be interviewing in January as well in Lima, I was curious if you have a date yet. Thanks!

Applied 2012-Approved K1 in 2013 (approx 8 months Noa1-approval)- decided to postpone marriage and live together in beneficiary's country before marriage.

Married 11/30/13 -lived together until filing

Filed for K3-04/06/2015

NVC case # 09/18/2015-case became CR1 (it's true what they say K3 is obsolete-don't even attempt it)

Paid AOS 09/18/2015

Sent AOS and IV packed 10/07/15

11/10/2015 Found out I had a checklist

11/18/2015 Scan date for information they needed after talking to someone over the phone regarding checklist

11/19/2015 FINALLY recieved actual checklist

11/30/2015 Sent one more extra tax transcript to avoid any possible further checklists

12/16/2015 Requested an Expedite

12/29/2015 Expedite approved, case being sent immediately to Embassy/awaiting interview date

12/31/2015- CEAC shows case as IN TRANSIT

1/11/2016- CEAC shows READY

1/14/2016-Received interview date/packet-case became IR1 (married more then 2 years)

Medical Scheduled 1/22/2016

Medical Completed

Interview Scheduled 2/18/2016

VISA APPROVED 2/18/2016

2/19/2016 VISA ISSUED

3/05/2016 ENTERED USA!!!!

3/16/2016-Paid GC fee

4/25/2016-Received GC in mail!!!!

First of all if you are an AMerican citizen you should have been filling taxes on income earned outside the US

W 2 is what employers send out in the US showing all withholding taxes but you would no get that in Peru

He needs to send to you IRS statement of taxes / he can do this by going to the nearest office and asking for one / they can print out the IRS tax returns for the preivous year

Meantime you need to file for the last 2 years and pay all taxes including Social Security, federal, etc.

To anyone else working outside the country, you should file and pay estimated taxes each quarter and do your returns each spring/ you are not exempt from owing US taxes just because you work ourside the US

I just re-read your post. There is no NVC in Lima, there is just a US Consulate, NVC is in the US. Are you sure you are correct on all your steps to the visa, it doesn't sound like you've submitted your affidavit yet, if not, you probably will not be interviewing in January. Where are you in the process now, I may be able to offer some help?

Eric, the "NVC" stands for National Visa Center which is only located in New Hampshire. Theyre the people that process your case. I think you mean you will have an interview at the US EMBASSY in Peru. Look i dont know what your situation is but its very similar to many americans living abroad thinking they dont have to file taxes due to low income. I too thought this way. FILE YOUR TAXES NOW. There are many online tax agencies that work with expats. Once your wife gets to the interview, they will require YOUR tax return or tax transcript for the last year EVEN if you have a co spomsor. They will delay your case if you havent filed your taxes by the time of the interview. As far as W-2's etc, that only applies to people working in the USA. Both you and I work abroad therefore these docs dont exist, you have to write a letter explaining this... As to why you dont have W-2's. Your wife will present this letter along with everything else they ask for. Sounds to me like you still need to read the CR1 instructions on here.

So many foreign terms, I think I meant to say "Embassy" instead "NVC" and leave it at that. Sorry.

Wasn't/isn't there a law that says anyone citizen living across seas that doesn't earn something like 9,200 a year or more doesn't have to file taxes?

Anyway, what's the best site to do file for the year 2014 as quickly as possible? Once it's all accepted by the IRS, will I then need to ask them to send me a form of it for the interview?

If you earn less than 9 grand you wont owe IRS anything however you Still need to report your income. I used greenback tax services. They charged me about $300 something to do my 2014 taxes. Expat deadline was on June 15. They prepare everything based on the info you send them, then they email you your prepared tax return which you will print, sign and mail to the IRS office in Texas. Before you mail it out to IRS, you can make a photocopy of it all and have wife take it to the interview as well. Keep in mind though that if she has an interview in 2016, they might request your 2015 taxes.
