I completed my MS in USA and returned to India in February 2015 with an EAD card. Now, I want to travel to USA on business purpose. I have been doing some freelance consulting for a company in USA from India for which i am getting paid. So the company has invited me to meet them there. So, I need to apply for business visa. Also, I have been exporting some products to that company from India. But the company in India that has been exporting products from India is in my relatives name and not my name. So, is it better to show that I am employee of the Indian company from the past 7-8 months that is exporting products to US company and so the US company invited me for business? Or, should I just apply as an individual saying I was invited by the company in USA to do business with them as I was doing freelance consulting for them from here in India ? Also, my last two tax returns have been in USA since I was there. I haven't filed any returns in India.

Your F1 is not, in fact, still valid, since you have completed your studies and no longer have a valid I-20---not that it matters, since you cannoy usee it nis anyway. You should present your current situation as honestly as possible..are you an employee of the exporting company or not? If nit, don't claim to be for a visa purpose.

I am an employee of that export company and also doing consultation for the US company for which i get paid separately. So, thats the reason i ask if its better to show that I am an employee of the company in India or just show that I am a freelance consultant for the US company ?
