I'm new here so I apologize if this is in the wrong place. This site is huge and a little overwhelming on first visit. Anyway, I've looked all over Google and can't find an answer so I joined here to asked.

I am living in Tunisia with my husband right now. I'm working on filling out the i 130 form to petition to bring him to America. What I'm confused about is if I can go ahead and send the form i 864 with this and also for the joint sponsor? Everything I see online is addressing sending these together with an adjustment of status which doesn't apply to us. Will sending it save us time or will they just ask for it again when it is sent to the NVC?

Also I am aware that my i 864 won't be valid if I don't have US domicile. I still have a mailing address in America which all of my credit cards and bank statements are sent to and I can get a letter from my mom stating we will be moving back with her upon returning to America. I can also write a paper stating that I am only intending to live here until my husband is able to join me in America. I'm pregnant and he doesn't want to miss the pregnancy and potentially the birth of his first child. Will this be enough or is there something else I should do/get?

Thank you for any help you can offer.

There's no point in sending the I-864 with the I-130 because USCIS won't even look at it. The I-864 is reviewed at the NVC stage and then forwarded to the embassy.

All that evidence sounds good for proving that you plan to reestablish your domicile. Just remember, you'll need a joint sponsor at the NVC stage if your current income will not continue once moving back to the US.
