I-130 and I-129F Approved on Same Date

Hi Everybody

My I-130 and I-129F have been approved :) both on the same date........ i just reluctanty checked case status online and found the both the petitions have been approved.

On March 1, 2007, we mailed you a notice that we have approved this

I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow

any instructions on the notice.

But whats Next...... i really dont have a clue.........! ok lemme check the Guides,Flow Charts and Message Archive, meanwhile if you can post something here to help me, i will be grateful.

03-28-2007:K-3 Packet is recieved

Congratulations! Now you have a pleasant dilemma. Well, your I-129F (K-3) will stay at NVC only for about 1-2 week and then NVC will transfer your case to the Embassy after a case number will be assigned by NVC. But your I-130 (C-1) will be at the NVC for about 3 months. So if you continue both, then your spouse will get the K-3 interview soon and then he can wait for the CR-1 interview as well to change the non-immigrant visa status to immigrant visa. Or your spouse can come to US with K-3 visa and adjust his/her status here. In that case, you can stop/cancel the CR-1 process. Or you can cancel the K-3 one while pursuing for the CR-1. CR-1 visa is the immigrant visa with which you don't need to adjust your status in USA. On the other hand, K-3 visa will bring you to USA quicker, but you need to adjust yoru status in USA. If your spouse wants to work in the USA right away, then CR-1 is also the best option.

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

thanks simple male

from ur post what i have understood is that for now i dont have to intervene? i should let them continue their processing, so later if i get K-3 visa i can go to USA and do AOS there, on other hand if K-3 is still pending(due to AR,AP etc) i can avail the interview for AR/CR and on getting immigrant visa can move to USA.

Yes, you got it. If the K-3 gets stuck with AR, AP, you can await for CR-1 interview and at that time, you would get CR-1 visa (Immigrant visa) in which case you would not do any adjustment of status in USA.
