Filing I130 for Parents - 1 in US and 1 in India

Hi

My mom is in US on B2, her I94 is valid until Feb 2016 and she plans to leave before her I94 expires. My dad came with her but left after 2 weeks. Both came to US for my sister's wedding. I am a naturalized USC and planning to file for their permanent residence. Should I file I130 for both parents while my mom is still here and go through Consular Processing OR can i file I130 and I485 for my mom while she is here and file I130 for my dad and have that application process via consular processing?

I didnt have any intention to file for my mother's AOS when she came to US but I am thinking about it now.

Yes, if your mom doesn't need to go back to India, then you can concurrently file the I-130 and I-485 for her. But, she won't be able to leave until she receives her EAD/AP card which can take a couple months after filing. So, it depends on if she needs to go back home or is able to stay until the card arrives. If she needs to go back, it's best to do the I-130 + consular.

For your dad, you'll have to go with the I-130 and consular processing route.
