CR1 + B2, NEED an advice.

Hey everyone. My husband and I are now starting a process of CR1. I have a valid B2 visa and I was told by USCIS that I can come and visit the United States while being in process for CR1. But is it possible to stay full 6 months and return to home country to finish CR1? There is a great chance my husband will be deploying again and I don't want to spend all this time apart while we could be together in a meanwhile. I DO NOT have any interested of adjusting my status while being on B2, we want to do it the right and legal way.
I know we could try to expedite the process but I am still worried it would take much longer. I don't want to come to the United States and have him deploy again after short period of time being together.

What are the chances of being denied the entry to the United States if I told Immigration Officer that I am coming to spend some time with my husband, showed him all documents and proved that I want to go back to my home country and finish the process from there?

You can stay the full 6 months. You were granted the B2 before you started the process and even if you were doing the process it's up the the BCO at the time whether or not they will stamp you B2 so to answer you last question, it all depends on the BCO regardless of evidence. I got stamped B2 every-time I visited the states from Canada. If you have a B2 Visa now you can stay the full 6 months

I was on a B2 visa prior to my inteview with plans to stay a full 6 months until we got the email. Again the BCO officer at the time didn't see a reason not to stamp me B2 as I had enough money to support myself for the said 6 months and I had a valid address and reason to return to Canada after those 6 months, but again each BCO is different.

If you got a yes, then you can stay is basically what I'm saying. You can return home after and still work on your CR1/IR1 application.

Yes, you did understand correctly. I am just worried if telling the officer that I want to go back to my home country to finish CR1 would be enough for him. In order to go back I have to quit my job. I have never had an issue with immigration, I go to the United States every month 2-3 times either way as a crew member (I am a cabin crew for one of the airlines in UAE) and as B2 visitor.

I just can't stand the idea of me staying where I am and getting the CR1 done shortly before my husband deploys for another 9 month tour.

I have visited several times under the VWP during our visa process and have never had any issues. Just bring proof of ties to your home country, such as mortgage/rental agreement, employment letter etc. I've never had to show any proof, but better safe than sorry. I always tell CBP I'm coming to visit my husband and haven't really had any issue, but then I have visited 20 times in the last five years and never stayed more than three weeks, so I have a very good track record as far as CBP is concerned.

The CR/IR-1 takes about a year, unless you get an expedite. I think I read somewhere that you can get expedited if the USC is on active duty. You should look that up because that could really cut your visa journey time.

FYI! CBP can't even see that you're in the visa process until you submit the DS-260 at the NVC stage.
