On the I-134 you write his CURRENT income, what ever he makes at this moment or at the moment that you fill out the I-134.


Tax returns are just used as support that he worked last year and usually used to prove stable job (but unemployment would contradict that).


To prove he CURRENTLY makes enough, you'll want to get an employer letter and show a month or two worth of paystubs. CURRENT income is more important than what his 2014 tax return shows.

I do my interview 30 septembre and co sais i need joint à sponsor because my fiancé tax return 2014 is not enough we thinking to do his unemployement tax 2014 and we found cosponsor is his brother they live in same house and he is retired he have IRS rax 2014 and is 17000

You can't add in more financial evidence at this point, and I don't believe unemployment counts as income for this. You also can't try to combine incomes for K-1 even if they live in the same house, you can only combine incomes for AOS, I-864, if they live in the same house.


You need to find a cosponsor that makes AT LEAST CURRENTLY 19,912$ by themselves, if they have no children. If the cosponsor has children, then the amount needed go up, but to sponsor JUST you, the person needs to make 19,912$. The cosponsor has to make enough CURRENTLY, this is proved with employer letters and paystubs, NOT with tax returns. Tax returns just show stable employment and income to give them an idea of if the person is financially stable or not.

Is your fiance unemployed? It barely matters what it says on his tax return, they NEED current employment letter, and paystubs for the job he has NOW. Unemployment is an unstable source of income, it will go away.

2014 Tax is usefull, Unemployment in the other hand is not stable earnings which is what they are really looking at. So unemployment along with a new job can possibly proof that stability. And remember that the income requirements for visa k1 is actually the mininum. Ex household of 1 is $11770.

Income Requirements for K-1, K-3, and CR-1 Visas

Only the U.S. Sponsor's income is considered when determining if you meet the income requirement.

The Fiancee Visa and the Spouse Visa do not have the same income requirement. Applicants for a a Fiancee Visa will need to show that their U.S. Sponsor's income is 100 percent of the federal poverty guideline. Applicants for a a Spouse Visa will need to show that their U.S. Sponsor's income is 125 percent of the federal poverty guideline.

For a Fiancee Visa a couple with no dependent children has an income requirement of $15,930 per year.

For a Spouse Visa a couple with no dependent children has an income requirement of $19,912 per year.

For the 48 Contiguous States
