I have a couple questions that I can't really get a clear answer to (even after a lot of searching).

1) Credit report on background check.

I've seen various answers on this. Most of which indicate that there is NOT a credit report done during the background check. But I still haven't found an official confirmation of this on the INS site or elsewhere.

2) Question about whether you've ever been detained or cited by a law enforcement official (including an immigration officer, etc.).

If someone crossed the border illegally (before they became a legal resident) and was picked up, held for a few hours, then sent back across the border, I'm assuming this means they were detained. But if no fingerprints were taken - and possibly no ID checked, but it might have been - then there's most likely no record in the system. When applying for legal residency, there was no question on the application that specifically referred to such a situation. But the n400 is more in depth with questions like that. So is it advisable to mark YES, a detention happened, or leave it at NO?

Also, if someone got a speeding ticket that was thrown out with a PJC, should that be reported as well? If so, should a driver history be collected from the local DMV - even if it happened more than 20 years ago (and there are no records about the ticket at home)?

These are a couple of the questions/issues that are tripping up completion of the n400 application.

Sorry i am going to counter question you. so they detained someone, did not took pictures or finger prints ? that is unbelievable .

Firstly, it hasn't been INS for almost 15 years. it is USCIS

1) I guess they can pull whatever they want on you. It all falls under 'good moral character'. My IO paid a visit to my boss to ask her questions about my moral character. I guess when you play the game, you accept their rules.

2) Obviously it was a detainment. Regardless if ID was checked or fingerprints taken, a detainment took place. This must be answered yes (and trust me, they probably already know regardless if you think they do or not)

Firstly, it hasn't been INS for almost 15 years. it is USCIS

The agency was referred to as INS way back when we were first interacting with them (more then 20 years ago) so that's what we still call it. Pretty sure most folks know what I meant. :P
