Well folks, after quite a few years I'm back...I have some general questions I'd like to ask just to see what I'll be up against IF IF IF my husband and I decide to file a spouse visa for him as he is just fine with staying in Tunisia...I was previously married and obtained an IR-1 visa for my then husband. Almost 2 years after being in the US our marriage headed south. I want to point out to the would-be haters that our marriage was LEGIT but we just had too many issues and ended the marriage in Oct. of 2012. I remarried last year and I am currently living in Tunisia with my hubby and have been here 1 year this month and IF IF IF we do decide to file it would still be some time yet before we do...at least 6 months or more.... I already know the in's and out's of possible consulate issues but as this would be my second time around this would open up a whole new set of possible road blocks. For now I'm just looking at whether it would even be worth trying or we'd be better off staying in Tunisia...to be honest I'd prefer to live back home so here goes...I already know a prior visa is a flag...can anyone that has been in a similar situation with a second visa offer any pointers or tips other than the obvious ones that I already am aware of as I've been through the process once before...tips and advice on any possible second-time-around flags, how involved will my ex have to be (I don't speak to him now but he still occasionally calls and visits my mother), just any helpful advice would be great as I'd hate to go through this again and put my husband through this and the outcome not be so great....thanks so much in advance for any responses

As long as you can prove that this marriage was in good faith and it wasn't for any other purposes I think you should be fine and moreso allowing for more time to pass before you apply for another cr1/ir1 application would also give your marriage more legitimacy.lastly be open to your husband about every detail about the previous marriage so when you both get to the point when you might be asked about it he has a better response

Thanks for replying :) ...i agree with more time passing before applying and with my staying in Tunisia it will also help show our marriage is legitimate and sincere...unfortunately we don't have much in the way of documented evidence other than photos (and if need be, written statements from his family and friends) and of course proof of my staying here in Tunisia with him..the lack of documented evidence such as emails, worries me a little but I'm hoping that the length of time I've been here will show validity and as I'm still in Tunisia for the time being I continue to put more time in with him...if we decide to file it will still be at least another 6 months or so before starting the process
