How to do the IR1-CR1 Visa while living abroad in Peru

I'm sure this question has been answered a bazillion times, however, I haven't found it.

I'm North American and have been married to my wife for about a year and a half now. We've been living this entire time in Arequipa, Peru. I've heard that it's possible to do the entire visa process while living abroad together, is this true? I'm going to have my Dad sign off on the Affidavit form when that time comes. As far as my U.S. address: I will be putting my parents house where I was living before moving here. I also know that Peru has an office to initiate the process. How do I send them the I-130 form to start the marriage visa process?

Hopefully this was all made clear to you.

You start filing at the USCIS field office in Lima. Here is their webpage: http://www.uscis.gov/about-us/find-uscis-office/international-offices/peru-lima-field-office

Even though your dad will be a joint sponsor, you will still be required to complete and submit an I-864 as you will still be considered the primary sponsor regardless of whether or not you meet the qualifying threshold.

great! thanks! Where I"m a little puzzled is the part about the second stage which would be the affidavit. Would it be possible to do that from down here in Peru also? In other words, is there a way to do the entire gig from abroad?

Reach out to the USCIS field office in Lima and ask if the I-864 is submitted with the I-130. When filing at an overseas field office, the NVC is not involved at any point. USCIS personnel does their thing with the file and sends it over to the Embassy's Immigrant Visa unit to continue processing that will culminate with an interview with the visa applicant (i.e. the file never leaves Peru, the entire process is done in Peru).

One thing I did not mention earlier, another requirement of the I-864 is you will need to show intent to reestablish domicile in the US or show that you have maintained domicile even though you have been abroad. Do a search for the term for options on how to show such intent or how you have maintained.

Would I have to have my Dad send me the proof of his tax returns and salary? I believe there's also a part about him putting his signature on the form, or could it be done through email?

Don't be sorry, it's no bother.

Answers:

• Your wife will have an interview at the Embassy with a CO (Consular Official); the CO will decide whether or not to issue the visa. This happens after all paperwork has been submitted.
• The I-864 your dad completes must be sent to you, an original signature is required. However, the accompanying documentation can be scanned and emailed to you. You would subsequently print it out.
