Hello again..........

I'n just thinking aloud here really.................

I'll be visiting my fiance in America at Easter and we'll finalise our K1 petition package at that time and then we'll get it mailed off :yes:

On the I-129, Part A, question 12 asks if the alien fiance is currently in the USA and asks for the I-94 number and expiration date.

Is there any problem (potential or otherwise) of us sending off the petition while I am in the USA or should we wait until I am back in England before she sends the package off??

Just wondering really.

It is absolutely no problem to send off the petition while you are in the USA. My fiance was here in the USA for 3 months, and that is when we sent our petition in. We just got approved yesterday :D So, no worries. It makes it so much easier to fill out all the paperwork when you are both together.

11.15.07: Green Card received

11.05.09: Removal of Conditions package sent to VSC

11.09.09: Package received at VSC

11.12.09: Check cashed

Nope, there's no problem at all with doing that (just don't overstay!) - it's what we did. I was there visiting my fiance when we filed in October - we put the I-94W number, date of arrival and date the I-94W would expire on the form in the relevant places, and then in the 'he/she last arrived as a' box, we put 'visitor (returning to London on 05/11/2006', just to make it clear that I was only there on a short holiday, even though they didn't actually ask when I'd be going back! It just made us feel better to put that...

Go for it... no need to wait! :)

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png

My fiance was still in the country when we filed and has since returned to Serbia. Our attorney (for whatever he's worth) actually incorporated that info into our letter since it helped to prove the fact that we had in fact seen each other within the past two years. So, as long as you return to your home country within the legal timeframe, I don't think it's a problem. Maybe someone else knows differently though.

** Sorry, we haven't done our timeline here yet - NOA1 December 25th...waiting for #2......soooooon we hope.**
