Glad that her sentence was reduced - two years for throwing ice is insane.

She's still an idiot.

I just noticed on the news that she is still under arrest because she has an outstanding warrant in Mississippi for check fraud..

No surprise here. It's never crossed my mind to throw something out my car at someone else. SHE HAD KIDS AND A PREGNANT WOMAN IN THE CAR. She's lucky if you ask me.

Once again, criminal punishment in this country is disproportionate.

Was the crime and the perpetuator of it, stupid? Yes, absolutely!!

Does she deserve a penalty? Of course. Perhaps a hefty fine ($2500 and probation). Not even one day of jail time.

As mentioned above, gun wielders often do not get such severe penalties. In fact, more serious crimes than that, often times get off without jail time.

Bottom line, we need consistent penalties nationwide. No political agendas for prosecutors, no vengeance plays, only straightforward justice, ala carte style. Everyone faces the same exact penalty for a conviction.

If she did that to my wife I would have punched her in the face. Right around the time I would be coming out of prison she would be coming out of her coma..

There is a legal difference, at least in some states, between assault and battery. Assault is the threat of violence, while battery is actual violence and is more serious. Waving or brandishing a weapon would be assault, while throwing something at someone is battery.

I'd think it would be either still assault, or "attempted assault." So essentially the same crime but with a lesser penalty, because it was unsuccessful. Much the same way murder and attempted murder get different sentences.

I don't think brandishing a gun in public is termed assault or battery - I don't know the legal term but I'm pretty sure it's something else. That said, what's more serious? Pulling a gun out in a road rage incident or throwing a cup of soda/ice at someone's car. In my opinion it's the former and as such should have the more severe punishment.

I don't think brandishing a gun in public is termed assault or battery - I don't know the legal term but I'm pretty sure it's something else. That said, what's more serious? Pulling a gun out in a road rage incident or throwing a cup of soda/ice at someone's car. In my opinion it's the former and as such should have the more severe punishment.

In Virginia anyway, the legal term for brandishing a firearm is - surprise, surprise - brandishing a firearm. There was actually just an incident where a South Carolina officer in training was charged for pointing his gun at someone during a road rage incident on I-81. Dunno what the penalty is but his career might be shot.

A. It shall be unlawful for any person to point, hold or brandish any firearm or any air or gas operated weapon or any object similar in appearance, whether capable of being fired or not, in such manner as to reasonably induce fear in the mind of another or hold a firearm or any air or gas operated weapon in a public place in such a manner as to reasonably induce fear in the mind of another of being shot or injured. However, this section shall not apply to any person engaged in excusable or justifiable self-defense. Persons violating the provisions of this section shall be guilty of a Class 1 misdemeanor or, if the violation occurs upon any public, private or religious elementary, middle or high school, including buildings and grounds or upon public property within 1,000 feet of such school property, he shall be guilty of a Class 6 felony.

i guess they could argue if its a total miss that they threw it in an act of frustration, not directed at the victim (could be a lie or truth). This reminds me of my post a few months ago where someone cut ME off, proceded to berate me, and once my finger was displayed, he threw a very large cup of fruit punch (like a big gulp) at my car - making it red on the passenger side. i guess he could argue that he saw that my window was UP therefore would essentially "miss" me. can a plate of glass between you protect the *thrower* from a battery charge (depending on the state of course)? hmmmm.

i guess it would just be attempted battery like scott suggested.
