Question:

My Fiance and I sent off the I129F,he got the whole pack back due to not filling things in correctly,he sent it off again but this time not certified.

When he sent if off we did notice that he forgot my G235A.

Now it is like 3 weeks ago and I have this feeling we are waiting on nothing,it could of got lost in the mail etc,besides from that the pictures you send in are only valid for 30 days.

Here my main question: He said he is going to cancell the old check and send in all the papers from new.

We did not have a case number and nothing on the first and god knows if it even got to the service center the first time anyway.

He said if he then cancells the check then they will cancell the papers from the first time.

I think it is a good idea to send everything in new is this a good idea??? Will it work???? HELP!!!!!

Chances are if he lets things go as they are, you'll get an RFE for the missing G325a. Just send it in once you get the RFE. I'm thinking if he cancels the check they will definately send all the papers back though, as rejected. If he decides to do this, then when you resubmit your petition, include the G325a this time. Hope this made sense. :)

Well he really wants to send it in new and does not want to wait,as I said when he sent it in the first time it was not certified and we dont know if it got there.

So we could really be waiting on nothing,the last time when something was wrong they sent something back within a week,not it has been 3 weeks.

I really dont know what to do.

I would not cancel the check. Chances are that you did get a case# assigned the first time, but the check was not cashed. Look on the cover sheet they sent to you. If your paperwork was returned to you, it was returned from the Service Center. If you get an RFE for a missing G-325a, it will cost you no more than about 1 week of time. So just wait and be ready to respond immediately if you receive an RFE. Never send duplicate information to a Government office. You'll just be creating havoc for yourself.

My first I-129F did not have my signature! They sent the entire package back to me, 2 holes at the top, documents organized they way they wanted them to be, with a cover letter on top stating what was wrong. However, there was a USCIS case number printed on the form. Even though they said they could not assign a case# until I returned the I-129F signed, there was a case number on the RFE page.

Nov 25, 2009 - I-751 is approved. No Interview.

Dec 14, 2009 - 10yr Green Card arrived !

Well how about he just goes ahead and cancels it now before they try and cash it?

I just dont want us waiting on nothing,especially due to it not being certified we dont even know if it arrived.

I would actually like to send it all in new,but are they going to complain or accept the papers then?

It is up to you. Canceling the check and sending it again new does not guarantee you won't get an RFE for something else down the line. Again, it's up to you.

Get him to call the bank and see if the check has been cashed? If so, just wait and see what happens
