APPLICATION FOR CHANGE OF STATUS ( TO H1)

Hi

last week the company i work for applied for the change of status from H3 to H1. The applications will be processed by the USCIS starting from April 1st.

From the 1st of april my application for h1 will be on pending, until it will be approved\ denied. Will i be able to apply for my marriage based green card even after my application for h1 has been submitted a month before?

i will have to fill out 2 forms for the green card : 1 for the change of status and 1 for the petition(filled out by my wife);

is it possible to apply for the change of status even if there is a pending request for change of status made by the company I work for?

I would have a chat with the Lawyer handling the case as you seem to have misunderstood the process and I cannot think why you are doing what you are doing.

To start with 1st April is the date new petitions for non cap exempt petitions can be submitted, nothing happens until they close the window, 10 days? or so later and conduct the lottery.
