Hello,

I am in the middle of preparing my husband's I-130 application, and noticed in the checklist here on VisaJourney that there are included the directions for filing the I-485 concurrently with the I-130. Is there a benefit to doing this? If we waited to file for his I-485 once he arrived in the states, is there a long wait? I ask mostly for financial reasons, as the I-485 filing fee is quite hefty. Does anyone have any experience waiting until arrival to apply for adjustment of status? If I applied for the I-485 at the same time as the I-130, would this mean that my husband would be able to work right away upon arrival in the States?

Thank you in advance for your help.

Are you filing I-130 for your spouse who is currently outside US?

If yes, follow this guide

Filing I-130, and I-485 concurrently is for those Adjusting status INSIDE US.

Done with K1, AOS and ROC

Thank you SO much. I got lost in the checklists and did not even look at the headline at the very top of the page! Yes, we are both in Portugal. I will be going back to the States soon, and he will be joining once the visa is processed. This is great - thank you for the clarification! :)
