Hi,

I really need help from the experts here. My mom wants to apply the N400 but as per the 2 criteria (30 months in the US in last 60 months and staying out of US less than 6 months), she is meeting the first criteria but she had one trip lasted 7 months out of US in 2011. I want to check how strict is USCIS in the dates spent outside US. It is just one month extra. Any suggestions or advises would help. Thank you in advance.

I've seen one or two applicants who were denied for staying outside the US for between 6 and 12 months, but it is very rare. It depends on other factors. If she spent 53 months in the US and one trip of 7 months abroad, they won't even question her. If she spent 29 months outside the US, she's likely to be questioned even if she didn't have any trips of more than six months.

If she easily meets the physical pretense criteria, she shouldn't worry.

It was back in 2011, so she should be fine.

JimmyHou, thank you for your feedback. There is another issue that she was in the US for 30 months only which is the meeting the minimum requirement so there are chances she will be asked in detail.

NancyNguyen, it still needs to be reported as we have to report it for last 5 years and this is one of the trips unless we wait until next year to get it removed from the last 5 year history.
