Hi all -

We've got the K1 paperwork finished. My fiance is signing the docs and will FedEx them back this week. Currently, I work as a contract employee for a large national company. I've been told conflicting information about my (the petitioner) employment:

* I must have a permanent FT job to keep my husband in the U.S. after we marry and while we apply for a Green Card

* I can work as a contractor or be self-employed as long as I earn 2.5x the yearly income for two adults at U.S. poverty level

I earn well over that amount, but am confused. Which is it? Anyone have any experience or knowledge about this?

What kind of financial support does your consulate require? If you fill in your timeline with the consulate, that will help people to provide you with accurate answers.

If you are required to use the I-134, you need to show 100% of the poverty line which is $13,200 for a two person household. Whether you work as a employee or contractor does not matter, although being a contractor means that you will have to show your tax returns. Requirements differ between consulates.

Down the road when you adjust his status in the US, you will need to show 125% of the poverty line which is $16,500 for a two person household. If you don't earn enough, you can use assets, savings, etc.

What are the income requirements for an Affidavit of Support?

You also must meet certain income requirements (whether you are a sponsor, a joint sponsor, or a substitute sponsor). You must show that your household income is equal to or higher than 125 percent of the U.S. poverty level for your household size
