PLEASE HELP! I got rejection notice on I485,131 and EAD package

Ok,

If you have an approved or pending I-130, you need to package that up with your AOS forms etc and send it back to the Chicago address. The I-130 should have been included in that package but it sounds like you sent it elsewhere.

Add a cover letter to your package. Indicate that you are adjusting status concurrently with the I-130 filing and explain that you had sent that to Nebraska. Hopefully this will work.

Other than that, you may want to make an infopass appointment at your local USCIS office and ask them for some direction on what to do.

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

here is what I did -

I mailed I-130 packet with 2 of G-325a (mine and my husband) inclues all supporting documents to "USCIS Nebraska Service CenterP.O. Box 87130Lincoln, NE 68501-7130". (we resident in Indiana)

I also mailed I-485 packet with I-131,I-765 include all supporting documents to Chicago office. ( I didnt include I-130 form though because I didnt know)

Did I mail to the wrong places? According to I-130 instructions, I am supposed to mail I-130 to Nebraska.

NOPE! for concurrent filing, you have to send 130 and 485 and all the supporting documentation and forms to the chicago lockbox only! Expect for some people who fall into the DORA. VJ members correct me if I am wrong...BUt, I did that and I have had no problems till now...

SO, just re-send your 485 along with I-130 to Chicago. If you I-130 is in Nebraska and the checks have been cashed, then, I am not sure what to do except to send your NOA of 130 being in Nebraska along with 485 and everything to chicago...dunno...maybe call USCIS customer service and ask them...if they will mail youe I-130 package from Nebraska to Missouri where all the family based applications for AOS go from Chicago Lockbox. :thumbs:

all three touched - jan 5 2007 (day 16)

I-130 and I-765 touched - jan 10 2007 (day 21) - HUH? What about 485???

biometrics appt - jan 11 2007 (day 22) - DONE (went early - got done in 5 mins!!)

Interview Notice Date - jan 12 2007 (day 23)

I-485 and I-765 touched - jan 13 2007 (day 24)

I-485 and I-765 touched - jan 16 2007 (day 27)

Interview Notice in mail for March 13 - jan 19 2007 (day 30)

I-485 and I-130 touched - Feb 21 2007 (day 63) - huh? maybe files arrived at local DO

I-765 touched - Feb 27 2007 (day 69) - Thank you Lord!!!

I-765 touched and APPROVED - March 2 2007 (day 72) - Card Production Ordered!!!

Interview day - March 13 2007 - APPROVED!! took less than 15 mins!!!!!

I am almost sure you can send copy of the NOA1 for I-130 with our 485 package, just explain that it is in Nebraska, if they need it they will transfer it, but I think everything will be okay.

Oh Boy.... ok I did I-130 and AOS and yes they should have all gone in one packet to Chicago.... now what you need to do is resend the AOS packet with a copy of the Original I-130 and a copy of the NOA1 that you have just received.... This should be accepted and they should begin to process your AOS...

You may want to make an infopass appointment at your local office to check with them that this will sort things out for you...
