hello!

I want to ask you something regarding I-864. Well I am not employed for few years and thus didn't file any tax return . However my mother and her husband are joint sponsors for my husband and filed I-864A. My question is that on I-864 part 6 question 13 I have checked that I have filed the tax returns, shouldn't the answer be left blank? second question on part 6 question 13 a 1 the income should be 0 right? my attorney has my parents 1040 total income figure written there since I answered that I would be using their income under 6a. I am really confused about this, please clarify this, I don't know whether it's their total income that needs to be written there or mine which is "0". Furthermore, I am attaching my explanation why I didn't file any tax returns as I am living outside of the USA at the moment.


my second question my daughter is recently born outside of USA and has became US citizen due to being a child of US citizen. W hen i filed AOS initially she wasnt born and thus my house hold size was only 2 (me and my immigrant spouse). Now that has changed should I file another form of I-864 and change that number to 3 (me, my immigrant spouse and my daughter). Please advise me I don't want another checklist. And also do my parents need to make any changes in their I-864a. I have read somewhere that child born to a us citizen who automatically qualifies as US citizenship doesn't require any I-864. Please kindly response to these questions

hi

the attorney is doing it wrong,

you the petitioner files an i864,

your mom or dad flies another i864 as your joint sponsor

the other parent files an i864A as his or her household member

you don't put any of their income on your i864, yours as sponsor is separate

they are combining their income on their forms, yours is $0

I'd say ditch the attorney or you'll get another RFE

each of your parents has to fill out a form

of course you have to change your i864, you have to include her, and redo your i864 because you don't put anything of your parents on your i864

Thank you so much for clarifying it. Another question since you saying that I would have to file another I-864 first due to my attorney being wrong and second having a daughter which changes the household size, can i sign it and then scan the document or fax the amended i-864 to my mother as well as to my attorney? would that be acceptable for NVC as the signature would come out as printed rather handwritten as getting scan or faxing it wouldn't have the luxury of handwritten signature? I know that people that having electronic processing they email everything, and there is no way for them to have the signature be sent in hand written form. Can i do the same, my problem being I am in the 3rd world country and the mailing system is highly unreliable and then on top i dont want the case to be delayed for another month just because of the signatures.
