New Healthcare Law - Penalty fee for being uninsured

Hi everyone,

I came here in January 2014 with a K-1 visa. Applied for AOS in February. I finally got my work permit in April. I was not covered by any health insurance company until May, when I finally got a job and I could afford health insurance policy. Since Jan- until May, I was uninsured, but I didn't get a final decision on my permanent residence status during that time.

Do I have to pay the fee for not having health care coverage for four months? Those four months I was waiting for my work permit/green card to be processed.

03-07-2014 Biometrics Appt. Successfully done
04-14-2014 EAD Card production
04-15-2014 AP approved. Notice sent.
04-17-2014 EAD Card was mailed
04-17-2014 (one hour later) USPS picked up card
04-22-2014 EAD Card/AP documents in hand!
06-05-2014 Notice of potential interview waiver received.
11-24-2014 GC Update: Card/Document production
12-01-2014 I-797 Notice of Action/Welcome Letter Received!
12-03-2014 GC received!!!

08/29/2016 Filed Remove of Conditional status
08/31/2016 Received NOA for ROC

02/23/2018 Lifting conditions approved. Card being ordered

03/02/2018 GC received.

Timeline

Doubtful. Even though Obamacare started last year, remember the government extended the open enrollment period until March 31st, even April 15th in certain instances. So, all of the 8 million or so uninsured people who signed up were just like you, no insurance until at least May. I enrolled at the time and my provider didn't start my policy until almost June. I don't believe the IRS is going to charge me the penalty, or anyone else who didn't have health insurance until May.
