My fiance will be submitting proof of termination of any previous marriages. She has received her ANULLMENT (also know as a "COURT DECISION" in the Philippines") followed by an AMENDED COURT DECISION which is still the same decision nullifying and voiding her previous marriage, and a CERTIFICATE OF FINALITY. My question is, is it the AMENDED COURT DECISION that must be submitted only? or does the first COURT DECISION also have to be submitted with the AMENDED COURT DECISION?

When i filed the k1 visa i attached all the documents coming from the Local Civil Registrar where your fiancee filed her annulment which include the decision,cert of finality and cert of authenticity no rfe got approved after 18days :) Goodluck and Godbless :)

I was annulled too. Way back 2011 , during my interview, they took the document from the court and also the Annotated marriage contract ( all original - it was sent back to me together with my passport when I got my Visa ). The final stage of annulment as far as I understand is when NSO annotate the marriage contract as Null and Void.

Always remember tho that the court document has to be registered at the Civil Registrar from where the annulment was filed and where the person got married. After this is done, it will be forwarded to the NSO ( final stage ) unless you want to risk showing at the interview without the Annotated marriage contract then that will be every applicants call. But what if during the interview the Annotated marriage contract is not yet available - or the NSO had not yet released this document and thus this will be asked - this is again something for every applicant to think about. Not every case is the same - so it will be yours to decide if you are willing to take the risk or get everything done before any problem occur. or take the chances that things will go smooth, ad worst is just face whatever problem there is afterwards. 1. Who will forward the anullment to the NSO?

2. How long does it take for the anullment to be forwarded to the NSO?

3. What is a annotated marriage contract? (I am presuming it is a marriage certificate with something written or stamped on it indicating the the marriage is no longer valid, nullified, and void?)

4. At the minimum, exactly what document does the U.S. consulate require the K1 applicant to produce at his/her interview as proof of termination of a previous marriage?

My fiance does have her COURT DECISION, AMENDED COURT DECISION, AND CERTIFICATE OF FINALITY. I figured that because these are legal documents issued by a court it should be sufficient enough for proof of termination of a previous and/or any previous marriages and if not, then what is?

I've read other postings made by other forum members in other threads stating that at their interview, they produced to the U.S. consulate their court decision, some stated they produced their annotated marriage certificated, and some stated they produce their certificate of finality. Taking an educated guess, this sounds like it means that as long as an anullment related document which states that the marriage is nullified and void is sufficient proof for termination of a previous marriage.

I'm not from the Philippines and I am not familiar with the process that you had just explained above so I have a few questions to ask you. In my case, after the annulment was finalized by the court, my attorney registered it at the Civil Registrar where I was annuled, I have to pay a fee for that. Then I was instructed by my attorney to have it registered at the Civil Registar where I got married ( another fee. The Civil Registrar will then forward it to the NSO, give you instruction and estimate when NSO will recieve the document, and to follow it up with the NSO if the annotated marriage contract was already in their data base.

2. How long does it take for the anullment to be forwarded to the NSO?

I forgot how long but the Civil Registrarwill give you those info. Mine just took a year because of NSO inefficiency.

3. What is a annotated marriage contract? (I am presuming it is a marriage certificate with something written or stamped on it indicating the the marriage is no longer valid, nullified, and void?)

It is the Marriage contract when your fiancee got married but with annotation at the upper right hand side saying "PURSUAN TO THE DECISION DATED xxxxxxxxxxx(DATE WHEN MARRIAGE WAS FINALIZED BY THE COURT) RENDERED BY JUDGE ABC D EFGH (THE JUDGE WHO FINALIZED THE ANNULMENT) OG THE REGINAL TRIAL COURT, XXXX JUDICIAL REGION, BRANCH XX, METRO MANILA ( EXAMPLE), UNDER CIVIL CASE NO. XX-XX, THE MARRIAGE OF ( NAME OF HUSBAND ) AND ( NAME OF WIFE ) CELEBRATED ON (DATE OF MARRIAGE) AT ( PLACE OF MARRIAGE) IS HEREBY DECLARED ANNULED ."

4. At the minimum, exactly what document does the U.S. consulate require the K1 applicant to produce at his/her interview as proof of termination of a previous marriage?

For the I-129 F we submitted COPIES of the following Document:

- Document from the Court

1. Certificate

2. .Entry of final Judgement

3. Decree of Annulment

4. Decision

-Annotated Marriage Contract

Interview: Same documents were asked but the ORIGINAL . They sent it back to me through the mail when they sent my visa.

Also, during the Medical, they will ask to see the Decision( Original- ones from the court). If the reason for annulment is psychological Incapacity against your fiance, she will be made to undergo Pschological test. If it isnot against her, then she is good.

Annulment is deemed final when you are able to secure the Annotated Mariage Contract from the NSO. It is up to you and your fiance if you are willing to take the risk and see if the USCIS will accept it this time, but always remember the court document together with the Annotated marriage contract ( original) will be asked during the interview.

Like what I said, every case is different, there are different consuls who interview applicants. It is again up to you and your fiance if you are willing to take the risk or just get everything done so that when it is asked then you do not have to worry about Administrative Processing or 221 G's.

Let me edit this..since I can not edit my previous reply.

In my case, after the annulment was finalized by the court, my attorney registered it at the Civil Registrar where I was annuled, I have to pay a fee for that. EDIT: ( Sorry for my poor memory ) In my experience, I brought the documents issued by the court to the Civil Registrar to the civil registrar where my marriage took place. Paid the fee there, the Civil Registrar processed it and ask me to come back few week, after. When I came back, they handed me a sealed envelop, gave me instruction where to send it and to mail it through registered mail. To keep track as to when NSO officially receive the document. The civil registrar give me the estimate as to when my Marriage contract will be annotated and possibly be entered in the NSO database. When the I reached the estimated time, I followed it up at the local NSO and see if my annotated Marriage contract is already available.

i suggest you forward the certified true copy of decision, cert and finality yourself, i did not relay anymore with the CR to do it, because it will take long. when i took it to NSO, the lady said i have to come back after 2 weeks then i can get an annotated marriage cert already. and when i did, i saw the annotation on my Marriage cert ....

i dont know if this still works now, my nullity was 2010.
