I am a US citizen. My wife is Chinese. We have been married for seven years. She has a 14 y/o son (Chinese citizen) and, together, we have a 2 y/o daughter (US citizen). We live in China and have for the past eight years. I am filling out the I-864 and I am form challenged. My wife and stepson are listed as IR1 and IR2. I filed two I-130's as required.

I file two(2) I-864's, one for wife and one for son. Each with duplicate supporting documentation (right)? My sister, who will co-sponsor, will also file two I-864's each with her documentation? (right)? Is my understanding correct?

Is the documentation for my son any different from my wife's.

Part 2 line 5. I have a GUZ and an AA confirmation number. What goes in the Alien Registration area if I don't specifically have an Alien number?

We want to stay together as a family. By filing two I-864's, and not filling in the "family accompaning" you, how do they keep us together?

Finally, thank you all. I really mean it. You have to be a paralegal to get through all of this. I understand the intent, it is the clarity of the instructions that tend to be less specific and more generalized. Once more, thanks. The empirical data available in this forum is priceless. Any and all advice is appreciated.

Answers:

  • Correct you file two I-864's and your sister as a joint sponsor (joint sponsor is the proper term, not co-sponsor) will also file two I-864's.
  • The documentation for both I-864's is not different.
  • Since you are filing DCF (as your information indicates), they'll keep the file together as one big file.

September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced

Ryan thanks so much. How do my sister and her husband file? He is the breadwinner. Do they both file or can they fill out one 864 showing their aggregate incomes?

Since her husband is the breadwinner, forms should be completed as follows:

  • her husband: two I-864 forms
  • her: two I-864A forms
