Hi friends,

Due to an irs cp2000 notice I received, I have to file an amended tax return for one of the tax year reported on the affidavit of support submitted to NVC. My case is already complete and sent to the embassy and the interview is scheduled. What is the best course of action for me in this situation? Should I fill out a new I-864 and send it to my spouse along with a copy of my amended tax return so that she can submit it to the embassy at the interview? Or should I just ignore it since I'm filing the amended return after the case complete. What are the possible consequences of reporting or not reporting this to the embassy. I'm not even sure about what the law requires in this situation. Can someone please enlighten me and suggest the best course of action.

I would send a new I-864 along with the amended tax return and supporting documents such as W2's. Yes she can give it to them at the interview. It is my understanding that the embassy can check with the IRS to see if you owe back taxes. You woud be surprised at the information the embassy can find out about you. Don't take chances.
