My fiance was married to an american but he changed his mind and filed for a divorce here in the US. We have a copy of the divorce papers. I have a few questions for everyone.

1. Does she need to have an annulment there before they will give her a K1?

2. Does she need a new CFO appointment since she is still coming to america?

3. Will she still need a copy of her cenomar?

I would be greatful for any help you can give me.

I just wanted to add that she went through the visa process under his name but her destination is the same and we didnt see an expiration date on the certificate.

There is no expiration on the CFO certificate, if you fiancee still has her certificate then she is good. She only needs to take the certificate to CFO after she has her visa.

There is no expiration on the CFO certificate, if you fiancee still has her certificate then she is good. She only needs to take the certificate to CFO after she has her visa.

No your fiancee does not need an annulment, being the USC petitioned the divorce it will be recognized in the Philippines, I don't know the details of the process may have to contact an attorney if you want to complete this.

The embassy will recognize the divorce decree.

With all that said I have a question. Was you fiancee married in the USA or the Philippines? This could change a few things.

No your fiancee does not need an annulment, being the USC petitioned the divorce it will be recognized in the Philippines, I don't know the details of the process may have to contact an attorney if you want to complete this.

The embassy will recognize the divorce decree.

With all that said I have a question. Was you fiancee married in the USA or the Philippines? This could change a few things.

She was married in the Philippines and never set foot on US soil because of a marital breakdown on his part. He started the process for a K3 but they never completed it.

OK. I read your fiancee already has her CFO certificate so no need to attend CFO a 2nd time... that removes one issue.

USEM will accept the divorce decree. Reason you need for the Philippines to recognize the divorce is for later; you would not be able to report your marriage to the Philippines, thus she could not get her passport in her (your) married name. And lastly she would be considered a bigamist in the Philippines.

Yes that was my understanding. we need to file to get the Philippine government to recognize her divorce. i just sent her a certified copy of her divorce so we can get that process started while we wait for the K1 process.
