Hi,

My husband do not make sufficient income from recent years due to his illness. Hence, he was not able to file for the federal tax return. I know we have to provide a written explanation.

Is it ok to say in the letter that the reason why my husband was not able to have a stable income is due to his illness which is severe depression?

Also, my husband and I do not have any plans of having kids. It is due to our own personal choice. Plus, if you look at my husband's situation it is not really practical for us to have kids. Will it have a bearing on the interview if ever they asked us about our future plans?

Many families decide not to have children, it is a personal choice. The US government does not expect every family to have kids.

Someone will correct me if I am wrong, but I believe that he is still required to file taxes, even if his income is low.

You need a cosponsor, do you have one lined up?

Many families decide not to have children, it is a personal choice. The US government does not expect every family to have kids.

Someone will correct me if I am wrong, but I believe that he is still required to file taxes, even if his income is low.

You need a cosponsor, do you have one lined up?

I do have a co-sponsor which is his dad.

He cannot file for his taxes because he was not able to meet the income requirement to file for a tax return.

I agree with Canadian_wife, Not everyone has kids through a second or third marriage ...and no government is allowed to oblige anyone to have kids to prove that their marriage is bonefide, sometimes some couple just cant have any kids period....and unless he had no income coming in at all, what ever he did earn has to be filed no matter what, and yes you are allowed a cosponsor when the petitioning spouse doesn't make enough money o support you.

You will both still need to go see a tax agent to make sure of this....better to be safe than sorry

My husband earned way below the minimum income based on this site: http://www.efile.com/tax/do-i-need-to-file-a-tax-return/

He is not required to file for a federal tax return if he did not meet the minimum income requirement.

And his dad also told him about this. Hence, he did not file for the tax return since he really did not earn that much.
