Your lawyer is stupid.

Of course you can get a visa in your maiden name. Your green card will also have your maiden name on it.

Visa in passport name, green card in visa name.

If you want your green card to have your married name, then you can either change your passport OR wait until you're in the USA and pay $450 to change it OR wait until you remove conditions (if applicable) to change it.

Likely you or your spouse (or likely lawyer) wrote your married name as your name on the I-130. Make sure to put down your maiden name in other names used. No matter what, your visa, if granted, will be in passport name and your green card will be in visa name. T

Now lawyer wants to delay stuffs because he still insist i need new passport But, we will be unable to complete and submit the visa application form until we get that new passport with my correct name. That new passport will contain a new passport number. he assumes my correct name is my marriage name

Your lawyer is stupid. Even if the new passport is available by interview you just take both passports and get the visa put in the new one.
