Duplicate responses from NVC and review periods

Good morning

This is a considerably long saga but needs to be explained to hopefully get some sort of reliable answer so please bare with me.

We applied in January 2014 for the 3rd time (I am the sponsor - born and raised in the US - and my wife and I have been married for over 33 years and we live in Australia where I am a retired US Marine).

In 1981 I was stationed at the US Embassy where I was in charge of marine security and met my wife who was granted alien residency and she returned with me to the US at the end of my posting. We remained in the US for over 8 years (she has a SS number and has 8 years of work credits, has a military ID card which allows her to go on any US military installation) before heading back to Australia for family reasons. In early 2006 we again applied and were granted her resident status. We went back to the US for 3 weeks in September 2006 to activate her visa and returned to Australia to sell our house, quit her job etc. Her father who was the sole carer of her sick mother died unexpectedly in early 2007 which meant she was required to look after her mother until her death in late 2008. Through our ignorance we didn't realise that she would have to go back there to keep her status active - she couldn't have done it anyway between 2006-2008

Late last year we again inquired into how we go about getting her resident alien status so that we can finally retire in Florida and were advised that we would have to commence the whole process again despite previously being given this status before.

We sent off our I-130 on 7 January 2014 and it was approved on the 19 June. Since then we have been going through the steps which seem to be taking for ever. For some reason we are getting duplicate letters from the NVC of the same content with different dates. Unfortunately and through my misunderstanding of a question on the I-864 form we have had to redo the form and send it back (I included my social security payment together with my Marine Corp pension as my total income). It was a mistake and happened because I misread the income section on the form although it was clear by the attached tax return that I sent them that it was a total of the two payments and not just the pension. With my income we are way over the poverty threshold.

We now have been advised that we have to wait another 60 business days for the form to be reviewed. The last time we called the NVC we spoke with a very rude woman who was not interested in explaining what I had to do and so I am reluctant to call again regarding the duplicate letters with different dates and the extended review time for (one figure on the form) in case we get her again. We have had such wonderful and caring people speak with us at the call centre previously but she must have been having a bad day that day.

Has anyone else experienced these type of issues and have any advice that they can give us regarding the duplicates and extended review period.

I suggest you call back and ask for a Supervisor, talk only with the supervisor about your concerns. The first person that answers the phone can't see the stuff in the computer to the same level that a Supervisor can.

Sorry you're having troubles - NVC got several different 'implentations' of it's tracking system this year, and they are bogged down with IT disasters.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.
