Hello VJs.....I received NOA2 and waiting for NVC case #, meanwhile, preparing for the paper work. Here is my question; I am the petitioner(USC), filing just for my wife, all my income stated in single W-2. However, I opened a small corp. in 2013 which has zero income but had expenses for 2013. Am I still qualified for I-1864EZ for?

Also, I filed for 1040 last year, so I think I need to put my "total income" as it appears on 2013 tax transcripts correct? or it should be "adjusted gross income"? thanks for any inputs.

As long as you meet the poverty guidelines with your income on one or more W2s then you qualify for the I-864ez.

You would use the total income because you filed a 1040, that is correct. :)
