I am sorry but you are wrong.

I have a B2 visa and went 4 times while my I-130 app was in progress. Never had a problem.

I will reply to you with the answer of the US consulate in Naples Italy.

Then I stop to answer to this kind of question, because I am tired.

Your wife can make a request of a B1/B2 visa, but we can't guarantee that this visa will be released. You will have to proof that you have not intention to immigrate in the United Stated and this will be hard to proof, because you have a request of immigration in progress.

Nov 13, AoS Bill received
Nov 21, bypassed NVC to Naples Consulate.
Dec 09 medical exam
Dec 10 interview and Visa approved

Hi,

It is true that it is much harder to get a B2 visa when you have a pending relative petition. However, the case here was people who already had a visa or VWP prior to being petitioned.

In either situation, it's strictly a case by case basis. If you can convince the CO that although you have a pending petition, you have very strong ties to your country, they won't deny it simply because of the pending petition.

Their job is to look at the pending petition as a negative indicator, but that's why they consider other evidence to help counter that.


The burden of proof here is on the applicant, not the CO.

I can tell you what happened to me...

My suggestion is:

if you are lucky, you can get a nice officer who can let pass your parents at the border, but if you have a I-130 request open, 99,99% of the times they will go back to their country.

You can't go to USA with an ESTA or B1 or B2 visa if you have a I-130 in progress.

Ahem, I entered twice while my I130 was being processed and on my b1/b2 visa. The second time I spent 5 1/2 months in the USA with my husband and we got a lease together. We had no issues with the border control nor the embassy at the time of interview. The embassy even granted an expedite as we showed that lease, our proof or marital conjoined resources was about to be up. I didn't lie to the CBP officer when asked and had no issues.

It is an individual thing so please do not tell others what they cannot do.

I-130 RFE Sent : 2013-12-30 (they lost his picture)

I-130 Approved : 2014-01-13

NVC:

NVC Received : 2014-02-21

Received DS-261 / AOS Bill : 2014-03-10

Pay AOS Bill : 2014-03-10

Submit DS-261 : 2014-03-10

DS-261 form reject- under review: NVC keeps saying the form is incorrect. They made an error for two months re this form.

Checklist 1 AOS : They wanted 2013 even though we filed before the end of tax season

Receive IV Bill : 2014-05-23

Pay IV Bill : 2014-05-23

Send IV Package : 2014-05-26

Checklist 2 AOS : 2014-06-06 Issue with resubmitted I-864 form - did not auto populate one of the numbers

Requested Expedite : 2014-07-11

Case Completed at NVC : 2014-07-18

Consulate Received : 2014-07-25

Embassy:

Receive Instruction and Interview appointment letter : 2014-07-29

Medical : 2014-07-31

Interview : 2014-08-08 - APPROVED!!!!!!!!!!!!!!!!
