CR1 visa has been denied

Hi everyone I hope someone can give give me an idea what's going on.

I had my Interview in April 4th the consular put me in Administrative processing ( no document needed) after 40 days they contacted me for a second interview they took my passport. I waited another 40 days they called and asked me to come to the embassy so i did then they gave me back my passport and told me that my case will be returned to the USCIS for a review ( i was in shock). then she gave me a white paper.

Further action in your case has been suspended under section 221(g) of the United States immigration and nationality act (INA) of 1952. We are returning your petition to the department of home land security's United States citizen and immigration service (USCIS). If USCIS determines that the information we are providing constitutes a sufficient foundation for initiating revocation proceedings, you will be sent a notice of intent to revoke that includes a statement of the facts and evidence and you will have the opportunity to respond. you may wish to consult the USCIS website for more information on how to contact the USCIS office nearest the petitioner's residence in the U.S

What do i do? what's the nest step?

Should i hire a lawyer?

How long does this review take?

you will be sent a notice of intent to revoke that includes a statement of the facts and evidence and you will have the opportunity to respond.

What do i do? You need to respond to the statement of the facts and evidence. Did they put down on the 221(g) paper and/or check on the reason WHY they are suspending your case and now in the initial revocation proceeding? Ask your spouse what questions exactly were asked at the both interviews. What were his/her answers to those questions and then check your answers that were written on your petition to see if they actually match. Somehow, there may be discrepancies to make them not believe him/her.

what's the nest step? You should find out asap what they found out on the beneficiary and the reason why they didn't approve him/her.

Should i hire a lawyer? If you can afford one, you could hire a lawyer to help you. But the main problem of your petition is that NVC discovered something and/or suspect that the beneficiary does not qualify for immigration to the US. Until you have the facts and evidence to counter their facts and evidence, hiring a lawyer may not result to anything.

Anyways, if possible, perhaps the spouse should move to Morocco and let time go by before filing another petition. This way if the reason for denial was not believing the relationship was valid, this would prove them wrong in the future petition. Hope this makes sense, but good luck and best wishes.

It will take sometime for uscis to receive the papers.. but if i were you i would start calling in 2 weeks. Read again where it says: "If USCIS determines that the information we are providing constitutes a sufficient foundation for initiating revocation proceedings, you will be sent a notice of intent to revoke that includes a statement of the facts and evidence and you will have the opportunity to respond."

You will be notified of why and then you will have a chance to respond.

Contact your Senator or House Member. At this point you want to find out what is going on, and they can do as good of a job of doing that as your lawyer can, and it is free.

you need call your congressman to, i have also prove my visa i till now m y case is under process my husband call the congressman
