Good evening VJ friends,

As you all know I am petitioning for my husband and step-daughter and it has been a complete nightmare to go through the process. When I finally though that everything was going smoothly, I hit a HUGE WALL, and now I am really freaking out! So, I completed the form I-864 last week and mailed it overnight to NVC. It was brought to my attention today that when filing part 3, I was not supposed to write down my step-daughter's name in:

FAMILY MEMBER 1

Part 2a. Is this correct? Did I just extended my waiting period at NVC? What should I do now? Should I write a letter to NVC explaining and enclose the new and corrected or should I just leave it like that? I would love for someone to enlighten me on this because I am about to lose it! Thanks ?

You filed two separate cases. So they need two separate I-864's, which I assume you sent. Also you are correct, you can't include either of them in part 3, because that section is only for people with other visa categories.

You only have to check the box that says yes in no 1 and enter "1" in no 7. So you should double check that you didn't write your husband's name on your stepdaugther's I-864 part 3 as well.

Therefore, you would need to submit two new I-864's and if you used a joint sponsor, you would need to submit those forms again only if you did the same thing.

About sending them now before they have had a chance to review them, I don't know. You should call them and make them aware of the mistake so that they can tell you if you can send the corrected forms right away or wait for the other ones to be reviewed first.


I don't think you would have to resubmit the supporting docs, so don't worry about those.

It was a really dumb mistake! I called NVC earlier today and they told me to send them again and to attach a letter explaining what is going on.

What about part 5 SPONSOR'S HOUSEHOLD?

Do I add my husband and my step-daughter? This is really confusing...

On your husband's form the household number will be 2

your husband as the immigrant

You

put zero for everything else.

On your step-daughter's form the household number will be 3.

Her as the immigrant

you

your husband as spouse

the rest as zero.

Thanks a million! This really helps. I guess that my hopes of having them here before the end of year are none. Anyways, I hope that when it comes time to file the IV, I get a break and it will be nice and easy.
