Hi folks,

I am a conditional resident with 2 year temporarily green card. I need to remove conditions on permanent residence based on marriage by the end of this year, Dec 21, 2014, to apply for the next 10-year green card. I have been married for 2 years and I haven't changed my last name to my husbands' yet, but I am thinking of changing with I-751 just as others since it will even charge me more (additional $450) if I change it at USCIS after issued 10-year green card.

I probably attach the copy of my marriage certificate with I-751 but the thing is, the document doesn't show my married name but my maiden name. I've been reading all threads on VisaJourney.com and found out some of you guys had filed with legal court order with I-751; but it costs me a way too much to be approved changing names besides paying $590 for filing I-751. I want to make sure to turn in COMPLETE documents without being asked for additional information, so I spoke to two different USCIS representatives earlier today to make sure what I am supposed to do. Then they both told me what I need to do is just attaching THAT marriage certificate with my maiden name. Even if that doesn't proof I can change names legally but it absolutely shows I am married with US citizen.

But, i know this is stupid to say, since that representative kind of sound like he has no knowledge of filing I-751, I want some of you guys' advices. Do you think I should just do what they told me, or to be safe, should I get a court order to proof that I am legally eligible of changing names? Awww I'm so lost!! I know I still have 4 more monthes to get things done but it seems like taking a lot of time to get staffs ready so I guess I'm overwhelmed...

Thank you and I am looking forward to hear from any of you!! :D

My wife had not changed her name either until it came time for ROC. All we did was enter her married name in Part 1 and her maiden name in Part 2. We didn't even send in a marriage certificate. I guess they didn't need it since in Part 3 they ask for the spouse's name. When she got her 10 year card it had her married name on it.

However, we did send copies with her married name on her SS Card and Drivers License. So maybe that helped instead of the marriage certificate.

Thank you for your response!

I think I'm unable to change my SS# and Driver's license since it's been two years after the marriage. Do you think I should walk in or call SS office to make sure I can change my name? it sounds much easier than attaching marriage cert and explain why it's attached on conver letter.

My wife walked into the SS office with old green card and marriage certificate and they processed the change. A week later or so she had a new card with her married name.

She did the same thing with her drivers license, although this may vary by state. We are in Texas.
