Hello all,

I need help on what form to file here. About 1.5 years ago my wife (Vietnamese) came to America with the financee Visa; however, her son (10 years old) didn't go with her (His dad didn't allow/agree his son to go to America with my wife). Now his dad agrees to let us bring his son over to America. Can anybody please guide me what forms should I/or my wife file so my step-son can come to America and unite with my wife? What is the timeline for this process? Thank you so much VJers.

You guys have been great. You have helped me with my wife's visa, please help again.

Thanks

Timeline

Basically it is the same process you went through with your wife but you will be sponsoring your step son.

Timeline is tricky, it has been a year or so, but Obama has mentioned Executive Action, that could easily push out the time lines significantly.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Did your wife received "permanent resident" status? = this would greatly help.

I would think this would be I-130, petition for alien relative-child IR-2/CR-2

here are the 2 links with all info for this situation
