I-130 to NVC - Additional Information??

okay so my wife and I had just filled out out I-130's . im putting our paperwork , pictures and documents etc. together. I am confused whether or not to send it up. For a couple reasons... does my wife need to change her last name to mine in her current passport? if so, that will be bad luck for me because I have her original passport, and birth certificate her in the US with me. and im very skeptical about sending those documents to the Philippines where she lives.

I think the I-130 site, is a little vague on what needs to be changed, because I don't want NVC to kick back our stuff, can anyone share me any of their wisdom please. maybe a good contact number. I will greatly appreciate it. by the way we are marred and she happens to be 5 months pregnant, I don't know if I need to say we have children or not, so im really confused. thanks

She will need to get a new passport if she wants to use your name when she gets to the US. As for sending those documents back to the Philippines use Fed EX. We had an error on our marriage contract and I had to send my passport, birth certificate and other documents to my wife in Davao. I used FedEX and was able to track the package and have it signed for when it arrived in the Philippines. It got to Davao in 3 days for around $80.00. DON'T SEND it IN THE MAIL. Both my wife and I have had several letters lost by the Philippine post office. Good luck.

she only needs to change her name on the passport if she wants her green card to be in her married name without a fee. It costs $450 to change the green card after the fact, OR you can wait for the removal of conditions.

Sorry to question this but why did u bring her passport together with u in US?

Anyway she need to change her passport on her married name, u have to send back her passport cause DFA will ask for it. She also need to bring birth certificate, marriage contract and cfo certificate when she do it.

I have it because i was misinformed. i am in the military, and they told me i need her original documents. trust me, it made no snese to me either. but now that i have made certified copies, and and notarized everything im going to send it back to her. so my question is this, can i send the I-30 packet ? or will it get pushed back from NVC or can i do it later when i get to the NVC stage? i think i will just get her new passport first before anything and have her make a copy of that and send it to me. do they need that to be certified and notariexed as well?

that link is clear, however, It doesn't specifically say "oh! your wife must have a new passport with her new name in order to be approved through NVC". so that's where I am confused. but I mean if she has to, then beter safe than sorry

so do I need to make a copy of a new passport then and send with the I-130? or will it be okay with out it?

if u are just starting to process your petition for your spouse it's mean you are not yet in NVC stage. if u are just starting to process your petition for your spouse it's mean you are not yet in NVC stage. Photo copy of her current passport it's ok for I-130 for now and documents,but u will need to send all her original documents later on at nvc stage exept passport (photo copy also for this stage) It's up to u if u want to renew your wife passport on married name. This doesn't give u a problem but expect some more paper works in the future, she can even renew her passport while u are waiting for the I-130 to get approve in uscis.

Need? No it's not needed. Your wife does not need to take your last name.

If she wants to take your last name and wants that last name reflected on her green card (without the $450 fee or waiting until ROC) then she will need to fix her passport before INTERVIEW. The NVC and the USCIS will accept everything as is and changing her last name is certainly not required.

Oh I forgot, yes passport of beneficiary is not needed in uscis. Got confuse cause we send our marriage military approval which contains my documents for more evidence.

When my husband sent our i-130, we included a COPY of HIS passport. He is my petitioner.

We are now at NVC stage, I'll be sending a scanned copy of my ppassport's bio-data page to him next week.

I don't think the beneficiary's copy of passport is needed in the USCIS stage. It should be included in the Immigrant Visa (IV) packet at NVC stage.

I apologized. Your wife's passport is not needed at the USCIS stage. So go ahead and file your petition without a copy of her passport. As others stated, your wife can use your last name in the I-130. In my opinion, it is better to use her married name now, so that you don't have to correct it later. If you decide to use your wife's married name in the I-130, send her original passport back so that she can apply for new passport using her married name. Once your I-130 is approved she can scan or send a copy of her new passport to you with the "original" documents needed at the NVC stage. Hope this helps.
