Hello VJers,

currently filling out forms for filing I-130 and I-485 together. I am the foreign spouse, arrived on VWP ~ a month ago. We got married ~2 weeks ago. (more details below)

a) I-130, C 2, address (and address fields on other required forms): do we take the address in the origin country, or - since I am already in the US, the address in the US where i am with my husband now?

b) I-130, 21, last address we lived together: i've been in the US now for one month. should i put my husband's address here since i've been here? we haven't lived together anywhere else.

c) G-325A, applicant's residence last five years: see b). i've been in the US now for one month. should i include my husband's address as present address since i've been here?

d) G-325A, last occupation abroad: just to confirm this refers to abroad from my origin country? (and not only outside the US).

- do you think this includes internships abroad? would certain countries here cause a potential delay? in my case internship in columbia (3 months).

- should internships not count, would you mention a contract with my Foreign Ministry for work in my country's Embassy abroad? I worked for a few months at the Austrian Embassy in Croatia.

e) employment related questions in I-130, G325a and I-485: i'm currently on vacation leave until the of August, then will start a one year sabbatical with my employer in my origin country to go back to university in fall. During my vacation here in the US we got married, decided for me to stay, well .... So technically, I have a present employment even though I don't work. What would you recommend I should fill in? Present employer yes? or rather say no employment?

Also the I-485 asks for current occupation, again not sure what to include.

Do you know if they contact the present employer?

and a few general questions:

f) I-130, 22, "Your relative is in the US and will apply for AOS to that of a lawful permanent resident at the USCIS office in ....." : how do I know which office that is?

g) any experience if being located in San Diego/CA effects the processing times (due to higher number of South American immigrants being so close to the border)?

h) any experience if coming from a European Union country effects processing times?

You live in the US now, so use that for your current address, same for residence with spouse.

Abroad means outside the US, it doesn't mean in your home country only.

To be successful in this process, you will need to read accurately and interpret literally. If in internship is a job, then it is a job.

To find your local office, you can look on uscis.gov, but you can also put Chicago lockbox there.

Check processing times for San Diego at uscis.gov. Where you are from makes little difference.

Answer all the questions truthfully and literally.

5/23/12: Sent out package
2/06/13: APPROVED!
