Hello guys,

I'm filling my petition to AOS. My husband and I were filling the I-864 form, and get the point about the past 3 years taxes, he was non-taxable for 2nd and 3nd past years.

For 2nd and 3nd past years, he was in his parents taxes, because he didn't make much money. What should we do? Can this interfer in the process?

Also, he started working at this new job August 13, so the tax for past year it's only the half amount. would it be a problem too?

What should we put at the forms?

File everything you can, especially proof of current employment and income. As for not having filed taxes, we're in the same predicament and we simply included a note explaining my husband was a student and a dependent during those years. So include detailed explanation why your husband did not need to file taxes during those years.

Edit: you might receive an RFE for his parents' taxes, I'm guessing that could happen to us as well. But for now just file whatever you can and they'll let you know if you need more.

02/04/2015: USCIS Welcome notice mailed

He just has to write a letter explaining why he didn't file taxes those years and get it notarized. If his current job puts him at 125% of the poverty level he should be fine even if he didn't work all of last year. As long as the income is at least the required amount and he will continue to have that income, he should be fine.
