Hello there,

I am a citizen of US. I did the I-129F petition for my current wife in 2011. She obtained the k1 visa and we marked her son on the DS-230 as he following my wife at a later date on line 29. Her son didn't follow her.

Her son applied for a tourist visa two time and it was denied.

The first time was submitted a couple of month later my wife entered US with her K1 when he was 20 years old. Technically in the one year period of his benefit of coming with a K2.

The second time he applied again for a tourist visa a year an half after my wife entered to US. Technically after that year of benefit. He was over 21 years old at that time.

After talking with many people I was told that the main reason he is being denied is because he applied for a tourist visa at the time that he has the one year window open (first tourist visa petition)

Because we are running out of ideas and resources I am trying to see if someone if going through the same problem.

Is there anything we need to do to show that he just didn't want to use the benefit of coming here with a K2 visa and only come to visit us with a tourist visa for a couple of weeks.

We are about to submit the I-751 for the removal of conditional residence. We are thinking to include him on the form and respond NO to the 5 & 6 questions.

We don't know if he apply for another tourist visa and he get denied for third time would be a bad history for he coming any other time to visit us and expend some quality time here with us.

Any thoughts, ideas

All help will be super appreciate it!!!

So her son is Argentinian? Shame as Chile is now a VWP country.

Argentina was but lost it due to abuse.

Suggest he waits until he can show strong ties to Argentina before trying again.
