I am currently filling my adjustment of status form, I came on a K1 visa and have married my fiance. We are filling the I-864, Affidavit of Support. My concern is my fiance is a student and has recently become unemployed and has no income, my question is can my mother in law co-sponsor me? we currently live with her, the household is myself, my wife, our daughter and my mother in law. Her income is above the poverty limit. Should my wife include her mother on her I864, part 5 question 7 which states the option of combining other household members incomes to my wifes and attatch the I864A, or should my mother in law fill out her own I864 as my co-sponsor?

Have the mother fill out her own separate I-864 as the joint sponsor. An I-864A is used by a qualifying household member to combine incomes with that of the sponsor filling out an I-864. Your wife has no income to combine with. The mother will only need enough income for herself, anyone claimed as a dependent on her most recent tax return and you, the intending immigrant. Your wife will only include herself, your child and you on hers.
