I am a UK citizen and my husband is nigerian. I also have my son who was born in America. Last year my husband went to America for a visit and went with my son. His parent tried filing for a green card for him but was rejected as priority date was not current. I was to America on my visa waiver for a visit last year and came back to the Uk. I then applied for a student visa to go do my masters and was refused. After a couple of months I decided to go visit on the same visa waiver and was refused entry as the immigration officer was not convinced that I will return. My husband applied for a change of status to a student and that has now been approved. My visa waiver has been cancelled and I have not been able to see my family for over a year now. I need advise on what to do.

I don't know what to tell you to do, but I will say that there is a lot of issues with women who are coming to the u.s solely for the purpose of having a U.S born child. When you went for you interview, they asked you if you were pregnant or planning to become pregnant. They ask these questions to avoid this situation. I can almost guarantee the reason for your denial was because you had your child in the U.S.. Also this may sound absurd, but if you owe medical bills from the pregnancy and birth, you will also be denied to return.

Were you specifically told you cannot use the VWP again? If so then you will need a B-2 visa to visit the US. Given the story as you have outlined it, I don't think you're getting one anytime soon.

I think a better path would be to wait a year or so and then apply for an ESTA again, unless you are permanently barred from using it.
