This morning my wife and I passed the visa interview. The only thing I needed to do was fax in my 2013 tax return. The fellow that I had was nice, and it took us awhile since we had to adjust the wife's application due to the communism question. He told us we were good and that it could take up to 90 days to get the card in the mail. Does anyone know the actual time that we can expect to get it? We'd like to attend her college reunion in July.

She misread the question. Like just about anyone in China, she was told that to go to school, get a good job, etc, she had to join, and her supervisor in China paid her dues back in 04, she thought that it meant if she was active in the party right now, and since she's not been in China since 04, except for a brief visit in 2012 for a wedding ceremony there, they asked that she change the answer she had put down. It wasn't a big thing.

I think it depends on the case. She was reading the I-485 Part 3 Question 6. The question asks "Have you ever been a member of or affiliated in any way with the Communist Party or any other totalitarian party?" In China, it's normal for people to join to get into grad school, hold office, etc. She thought that since it was capitalized, it was the proper noun, IE the soviet Communist Party, not the CPC, the Communist Party of China, which was the proper name. Like I said, the interviewer was very understanding and knew all about the situation with getting a job or going to school. It was clear he'd seen plenty of Chinese people applying for a visa. Joining is more or less mandatory but she essentially quit when she came to the US to study here and hasn't paid dues or anything like that since she got here.

So She Originally answered "yes",But should have wrote "no" ?

bpierce - you two won't be doing any adjustment of status, based on your visa type.

just a fyi. might be doing a removal of conditions, using form I-751 - 2 years after she hits usa dirt - so keep that in mind.

Ya know, you can find the answer to your question with the advanced search tool, when using a PC? Ditch the handphone, come back later on a PC, and try again.
