I have one friend who did this inadvertently and it extended the time her husband could come over because she had to start all over again with filing K3. Now, I know of another person who has filed K1, but in the mean time has gotten married in Morocco, refers to her man as her husband, and plans not to make mention of this to USCIS. I'm not so much one to say "it's the law, you must follow it" however, I do think she's rolling the dice on this one and quite possibly might ruin her chances of a visa for her man. Or not? I know I should probably post this in the K1 forum, but I'm actually not asking much about what will happen should the authorities find out, just wondering what any of you would do if your friend was going about things this way.

p.s. if anyone knows what could happen should the authorities find out, you can tell me :P

Something similar happened to my cousin in Jordan. She got married and they went to an attorney who strongly advised them to file a K-1 even though they were married because it was faster :wacko: . Anywho, during her interview she had no intentions of mentioning that she was married however they somehow dragged some stuff out of her without her realizing it that gave them enough reason to doubt she was just engaged. After some more interrogation, she eventually cracked. They denied her the K-1 visa (she waited a year to get that appointment) and told her she had to refile for a K-3. So now they are back to square one filing the petition with the USCIS.

Yeah, I pretty much figured it's really stupid to try to pull one over. I think some of the fiances have found it hard enough with the pics of the engagement parties, right? As in, the CO isn't always convinced it's not a wedding rather than engagement?

Well that's what happened to us. They got concerned when they saw the photo of us with the priest even though I was not in wedding attire or a church. They insisted on having the name of the Priest and the church he was from to verify.

I don't know, I'm out of my depth here, I didn't go through the visa process, I only know what I've learned from you ladies. Is DCF only if she is in Morocco?

Yes filing the petion in Casa... I think it is possible... but she should check the residency requirement. In Algerie, where my husband is from there is no residency requirement... but I think someone told me in Maroc it is 6 months...

Firelion, where are you? I think she would know.

Oh, well, she lives here. She just got married on one of her trips there while waiting for the K1 interview.

If there is any doubt about their relationship or that they are already married, they will be denied and have to start from scratch again. I don't think it is really worth it. When they go to adjust what would they put as to when they were married? Are they going to marry here too? Working in law enforcement, I can say that it doesn't pay to try and beat the system. At some point it will catch up with them. I have seen it happen many times, expecially when it comes to USCIS. People have thought they beat the system and then years later, out of the blue...it all falls apart.

She most likely just messed up her chances of her SO ever getting here. If she filed the k1 already she should have waited the outcome. Now that she got married and did not let USCIS know her chances are worse. She could have cancelled her k1 first with reason and then married and filed the k3. She might need to find a very good lawyer. If you want more info send me a PM.
