Hi!

I am the Australian beneficiary and my US citizen fiance doesn't work and hasn't for many years. He owns property, one of which has a tenant in that pays rent. He also has a lot of accessible money in savings. If he has zero income on his last tax return, will we run into trouble at the interview? How do I know if he needs a co sponsor or something? How do I know if he needs to prove that he owns the property and the value of it? Can we do the AOS with just his savings?

For property, you need to provide an appraisal and proof of any liens to get the net value. All assets need to be able to be converted to cash within a year without financial hardship. You need a bare minimum of $60k in assets to qualify on assets alone for a household of 2. If he is making rental income, wouldn't he need to report that for tax purposes? Did the rent just start this year? He can provide proof of the rental income as well.

He can also provide a co-sponsor that meets the requirement for their own household size plus the foreign fiance(e).

Hmm, thanks. What if he had over $60k in the bank in savings? I imagine that would be favourable? Will they even care about assets?

It will depend on the CO and your case. It is solely they alone that will decide if they believe you will become a public charge or not. I suggest you email your consualte and ask them directly if someone applying for a K-1 can have their petitioner/sponsor qualify with only assets for the I-134. You could also ask them the guidelines for assets with the I-134, how much is needed and what documents to prove ownership and value would be needed. Things differ from one consulate to the next.
