good evening po,

i'm just new here,and still on process of my annulment of marriage actually waiting for the courts decision..

i just want to ask if court granted my petition and i have the courts decision, can we start filing k-1 with courts decision? or i have to wait for my finality decree? thank you

You will need to include a final decree of annulment with the petition. You cannot file until you have it.

the decree of finality from the court is not just enough. the end of the process in annulment is getting the annotated marriage contract from the NSO. In my K1 visa experience, the USEM asked to see the original annotated marriage contract too together with the court document.

You need your final decree before filing the I-129F petition, and you will need your annotated CENOMAR from NSO when you apply for your visa at the embassy in Manila.
