Please help me understanding this checklist from NVC. Is the bold underlined part below a general statement or we really have to provide them with that? the Petitioner didn't file a tax return last 2009. But it was already okay for he already paid. and the IRS records he submitted to NVC are just the past three years. Can anyone help me understand this. Thank you.

NVC has reviewed the financial evidence submitted. However, additional information is
required to complete the financial evidence review. Please provide all requested documents and
refer to page two for mailing instructions.
General Instructions
[x] The checklist below indicates missing or incomplete documents.
Supporting Documents missing or incomplete
[x] A written statement/explanation as to why tax returns were not filed is required if you are/have been
unemployed, retired or dependent.
[x] The listed income tax documents/IRS statements for the years marked below are missing/incomplete (if you
have lost any of the requested tax information, contact your local IRS office to obtain a copy) (Only Federal
returns (not state or local) are acceptable unless the sponsor's income was earned in Puerto Rico.)
• Federal income tax returns, literal printouts from the IRS (RTFTP) or a Letter 1722 issued by IRS
are missing/incomplete for the year(s): [x] 2013 [ ] 2010 [ ] 2009 [ ] 2008.

Please help me understanding this checklist from NVC. It looks like they do not have ONLY the 2013 cos it's the only one marked. The bolded statement is something you provide if you cannot provide the documents they requested. It wouldn't make sense for you to provide the explanation why tax return were NOT filed, when in fact you did. and can provide the proof of it.

As far as I know, they only require last 3 years financial record (I may be wrong).
