Wired situation about K1 visa

Hello All,

I have a question that may be wired and i hope nobody will throw something on me. :innocent:

Me and my fiancee are starting the process of k1 visa with me staying in china.

I was thinking is it possible to start the process providing my address in my country and when they will start sending packages to me i will go back there.

I hope it's not silly question :unsure:

Married 2/23/2008 In Hong Kong

Filed K3 4/28/2009 (my husband had some issues with his Chinese visa)

CSC received May 1, 09

NOA1 May 6, 2009 (received in mail on 5-8)

Sent I29 May 9th, Received May 11th

NOA1 for I129 May 18th, 09

Received in mail on May 26th

I-130 Touch 8/14/2009, approved 9/1/09, 1129 touched 9-1,2,3, approved the 1st.

NOA2 for I-129 not received

Hong Kong Embassy received it on Sept 14th, 09

Packet 3 mailed out on Sept 22,09

I130 at NVC now

Received email Sep 23 about electronic processing for CR1

Packet 3 mailed on Sep 22, received on October 5th

Mailed packet 3 back 10-9 to Hong Kong, awaiting packet 4

Packet 4 mailed 10-15, Interview set for Nov 10th

In AP a little over a month

Got approval notice Dec 17th

Dropped passport off on 12-21

Received visa 12/24.

Flew to St Louis 12/29, now home.

Not silly at all, yes you can as long as there is some on back home that can collect your mail, and let you know if you got RFE, NOA1, NOA2, ect.

I assume you maintained your residency at a parent's home.

Also if you have not found it yet, check out CFL http://candleforlove.com They cover all things Chinese/American visa and relationship related.

One other possibility is researching DCF if you plan on staying in China for a while. Marry there, and file for CR-1 visa at the consulate.

Well thank you i plan on doing it from my parents house but then one problem is when do i have to be physically present at my country and what about my phone number do i have to provide one of my brother for example?

Also there is one step when i have to provide copy of my passport so how it's going to work with my out of my country?

You don't have to be physically present in the US until your AOS interview - long after she receives her K1 visa. Give the phone number that matches the address you are using i.e. your parents. If you have to provide a copy of your passport, send a copy. It doesn't matter where you are located when you are mailing in copies, and even if it did, you would have your passport with you when out of the US, right?

This sounds contrary to what your fiancee posted on 29 December. Why don't you explain a little more about what you situation is, where you would prefer to apply for your visa, and why.

We met last month and we are starting the k1 process.

I asked the question about DCF and about starting the process from my country because i read it takes around 9 to 11 months to get a visa from china.

Also i'm living in china on A F(Business visa), so i'm not illegal here.

If you are legally in China, you can use the Chinese consulate, if I am not mistaken.

I understand the same as you that the visa application process does take a long time in China, longer than in most other consulates. I don't know about Algeria.

I also don't know if it would be more difficult, as in the consular officers would be more difficult to satisfy, in Algeria or in China. But it would not surprise me if the consular officers in China would be uncomfortable dealing with an Algerian national, being unfamiliar with them, and would therefore be more careful and perhaps take more time reviewing the case than they would normally.

You have an interesting dilema, deciding which consulate you would prefer to apply at.
