I130 & 129F Approved at the same time

Hi everyone, I am hoping someone can help me. I am confused.

On Dec. 27/06 both my I130 and I129F were approved at the same time. My I129F is now at the Montreal Consulate and I am awaiting to receive my checklist.

My intention is to have my interview at the Consulate in Montreal, when approved fly to the US and once in the US file for an ajustment of status and EAD to be able to work.

What do I do with my I130 approved application now, do I just leave it alone until I get to the US? Do I have to call the NVC to let them know my intention.

Here is what the approval reads.

I 130 Your petition is approved. The petition indicates that the person for whom you are petitioning is in the United States and will apply for adjustment of staus. He or she would contact the local INS office to obtain form I485, Application for Permanent Residence.

If the person for whom you are petitioning decides to apply for a visa outside the US based on this petition the petitioner should file form I824. Appliation for Action on an approved application for petition, with this office to request that we send the petition to the Department of State National Visa Cener (NVC).

Any help would be much appreciated.

Hi there,

Congrats on your approvals.

I'm in the same boat as you. I already rec'd my packet for the K3 from the NVC. In the meantime I did send in the I-824 to have my I-130 transferred to the NVC since I'm still living in Canada and only plan on moving to the States sometime in July. I think I will try for both Visa's and see how far I can get depending on the waiting times. :innocent:

Lana Rascoe,

You don't do anything for your I-130. I-130 has to be approved in or in process inorder to apply for AOS / EAD in US. You have two options now:

1. Apply for K-3 at the US Consulate at Montreal, travel on it to US and apply for AOS / EAD from within the US.

2. You can take the I-130 route and ask the NVC to send the approved I-130 to Montreal Consulate where you will apply for CR-1 (takes a bit of time).

If you choose to apply for K-3 then don't do anything for your I-130. Its an approved petition and keep the approval notice with you. You will need it when you apply for AOS/EAD in the US.

As the notice that you quoted tells you, the USCIS will not send the approved I-130 petition to the NVC unless you tell them to do so by submitting form I-824. So you do not have to tell the NVC anything.

I understood that if you went the K3 route your visa that is stamped in your passport at your interview would allow you to move AND work in the US right away ....so you can get down there and get working and then apply for permanent residency. Is this not the case? I work for an American company in Canada and would like to transfer with them so I need to have work approval before I move. It seems like the I129 approval means you skip right to the medical and interview whereas the I130 means all those forms exchanged with the NVC for a few months before the interview....if I am reading these posts correctly.

The CR-1/IR-1 visa is an immigrant visa. You get your green card and are permitted to work right away. This is the 'better' visa but it also takes longer because of the additional processing at the NVC. The K-3 visa is a non-immigrant visa. It is generally the quicker route because it's quickly forwarded on to the foreign consulate/embassy but once you're in the US you will have to adjust status and apply for permission to work once you're here. Which route is best depends on the people involved. For my wife and I we are choosing the K-3 route because we value being together quicker more than an immediate green card and ability to work.

I wanted to mention that our I-130 was approved on the same day as our I-129F but I never received an Email notification and the online status is still pending. I received both hard copies of the approval notice in today's mail.

Both consulates in Canada that do K3 visas Do Not stamp your visa on the day of your interview. They mail it to you, or you hang out in Montreal or Vancouver a couple of days to go pick it up. K3 does not allow you to work upon entry to the US. It'll be about 3 months (minimum) before you'll be able to work.

If you want to be able to work immediately upon entry, wait on the CR1.

Both consulates in Canada that do K3 visas Do Not stamp your visa on the day of your interview. They mail it to you, or you hang out in Montreal or Vancouver a couple of days to go pick it up.
From what I've seen, Vancouver will issue the K3 on the same day in your passport, whereas Montreal will mail it back to you. Did you see any change in policy with Vancouver?

People. I got my I-130 approved and I didn't even sent anything telling them to forward my I-130 approval to NVC. I believe that they are now sending it to the NVC in order to speed up the processes and help others. Remember that for NVC, getting the I-130 means, CR1, etc visa..which for them it also brings in some $$$$$$. So, K-3 $$$ plus the CR1 $$$ = $$$$$, it wouldn't hurt them. My suggestion is to go along whatever comes your way.

My K-3 case is already at the Embassy and my CR1 is in the process to be completed. So, I assume my spouse will get the interview for the K-3 and then once the CR1 is approved, it will then be forwarded also. I don't think I will let the CR1 go to wasted when I spent $380 dollars for Visa bill.

But if you come to the US, and you haven't heard from NVC, then file for adjustment. Otherwise, it wouldn't hurt to go to the interview in your country and that gives you a case for a good visit to your family.

Well congratulations anyway!

Pursue the I 129F it is much faster and will allow you to be together here in the US quicker. At one time I thought that we would also pursue the I130 also but changed my mind when I considered going back to the Philippines another time for the Green Card interview.
