Our situation is this:

- We met online in early 2011, great friends.

- He (US citizen) visited me in Australia mid 2012 for two weeks, we were officially in a relationship around then.

- I came to the US on a visa waiver from Nov 2012 - Feb 2013.

- I entered the US on a J1 (for a working holiday) last year, which will expire Aug/Sep this year.

- The 2 year home residency is not a requirement.

After being able to spend so much time together we have decided that we'd like to stay together. Is it possible for us to marry whilst I am on the J1 and apply for AOS? I would still need to travel back to Australia sometime at the end of this year or early next year for a short stay. I have read about prior intent being classified as visa fraud however, marrying was not the intent prior to my arrival but time together has changed that.
