Working in Canada, while living in USA

Actually if someone didn't reside in Canada but continued to use Provoncial healthcare, that would also be illegal. You must reside in a province 183 days per year to maintain health care benefits.

Just something for the OP to think about. It may be better for your gf to move to Canada vs the opposite if you do not intend to leave your job.

Timeline

Yeah not going to be an option at this time for her to move to Canada.

I still have to make a decision about either going with a K-1 or IR1/CR1. I really don't want to wait too long, but it seems as both options require some wait time. I would not want to leave my company in Canada, unless it was that I found a new opportunity in the USA.

I guess I couldn't do a DCF?

DCF isn't available in Canada.

You can claim EI benefits on both CR1 and K1 after moving to the USA BUT they're immediate on CR1 and on K1 you have to wait for the EAD.

The benefits to K1 is that getting the visa itself is quicker and you live with your spouse after marriage.

CR1 is quicker to green card (most often) and cheaper, (unless you live in BC).
