Hello,

My wife has US citizenship, and she applied IR-1 for me 12 years ago.

We have not any answer from the immigration, and time passed on.

Actually we did not care about that so far.

But, I need to visit the US to see my family.

Can I apply for B1 visa in this situations?

Is there anyway I can check my IR-1 case status without having much information?

Something is wrong. There is no waitinglist for the spouse of a US citizen, you should have your visa within a year. Even if she was only a greencard holder, at most it would take 2-3 years, NOT 12 years. Either she did not send the petition/ they did not receive it, or it would be considered abandoned by now since it;s been 12 years.

To your question though- you can apply for a tourist visa, but it will be difficult to get, as you have a US citizen wife and file an immigrant petition, thus clearly have immigrant intent. You'd need to show strong ties to your home country, reasons you will return home.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
